PLEASE READ THESE TERMS CAREFULLY. BY PARTICIPATING IN THIS PROMOTIONAL OFFER, YOU (“USER” OR “YOU”) AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING ANY CHANGES THERETO, AND ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND OUR PRIVACY POLICY AND GENERAL TERMS OF SERVICE.
This promotional offer (“Offer”) is available only to Individuals who have not previously subscribed to Mochi Health. Users with active subscriptions or that previously had an active subscription with Mochi Health are expressly excluded from participating in the Offer.
Mochi Health Corp. (“Company”) reserves the right to verify eligibility and deny access to the Offer for any reason, including but not limited to prior account activity or suspected abuse.
Eligible Users subscribing to a multi-month Mochi Health membership (“Membership”) with a valid offer code will be credited the value of one month toward the total Membership plan costs. The Offer explicitly excludes any medication costs. Following the expiration of the promotional Membership period, continued Membership will be billed at Company’s standard plan rates.
This Offer is non-transferable, has no cash value, and may not be combined with any other offer, discount, or promotion unless expressly stated otherwise.
To activate the Offer, a valid offer code and an authorized payment method must be provided. If the User does not cancel the subscription before the end of the promotional Membership period, the payment method on file will be automatically charged the Company’s then advertised standard fees for the User’s selected plan beginning with the first billing cycle after the promotional period.
Company reserves the right to modify, suspend, or terminate this Offer at any time without notice for any reason, including but not limited to fraud, abuse, or technical issues. Company also reserves the right to cancel any subscription believed to be in violation of these terms or Company’s Terms of Use.
TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL COMPANY, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO USER OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS OFFER OR THE USE OF OR INABILITY TO USE THE SERVICE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or relating to this Offer shall be instituted in the federal or state courts located in San Francisco County, and each party irrevocably submits to the exclusive jurisdiction of such courts.
These terms, together with the Company’s Terms of Use and Privacy Policy, constitute the entire agreement between the parties relating to this Offer and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
